When do you not have to get a work permit in Poland as a foreigner?

Foreigners do not need a work permit and can work on the territory of Poland if:

  1. they have refugee status granted in Poland;
  2. they have subsidiary protection in Poland;
  3. have a permanent residence permit in Poland;
  4. hold a residence permit for a long-term resident of the European Union in Poland;
  5. they have humanitarian residence permit;
  6. have a tolerated stay in Poland;
  7. they have temporary protection in Poland
  8. have a valid certificate issued based on art. 35 par. 1 and 2 of the Act of 13 June 2003 on Granting Protection to Foreigners in the Territory of the Republic of Poland
  9. are nationals of a Member State of the European Union;
  10. are nationals of a country of the European Economic Area which is not a member of the European Union;
  11. they are nationals of a State that is not a party to the Agreement on the European Economic Area, which may exercise freedom of movement for persons under an agreement concluded by that State with the European Community and its Member States;
  12. are nationals of the United Kingdom of Great Britain, Northern Ireland referred to in Article 10 1 letter b and d of the Withdrawal Agreement or a family member referred to in art. 10 par. 1 letter e and f of this Agreement;
  13. accompany on the territory of Poland a foreigner referred to in points 7-9 of art. 87 of the Act on the Promotion of Employment and Labour Market Institutions (i.e. a citizen of a Member State of the European Union, a citizen of a Member State of the European Economic Area, not belonging to the European Union), as a family member within the meaning of the Act of 14 July 2006 on the entry into, stay in and departure from the territory of the Republic of Poland of citizens of the Member States of the European Union and their family members;
  14. accompany a Polish citizen as a family member in the territory of the Republic of Poland within the meaning of art. 2 item 4 of the Act of 14 July 2006 on entry into the territory of the Republic of Poland, stay and departure from this territory, of citizens of the Member States of the European Union and members of their families (Dz.
  15. are persons referred to in art. 19, sect. 2 item 4 of the Act of 14 July 2006 on entry into the territory of the Republic of Poland, stay and departure from this territory, of citizens of the Member States of the European Union and members of their families (Dz.
  16. have a temporary residence permit referred to in art. 114 section 1 or 1a (so-called single temporary residence and work permit), art. 126  (temporary residence permit in the case of performing a function in the management board of a legal person), art. 127 (the so-called EU Blue Card), art. 139a section 1 (temporary residence permit for the purpose of performing work as part of an intra-corporate transfer), art. 139o sec. 1 (temporary residence permits for long-term mobility of a managerial employee, specialist or internship employee, as part of an intra-corporate transfer) or art. 142 section 3  (permission to perform work by performing functions in the management board of a limited liability company or a joint-stock company that the foreigner has created or whose shares or stocks he has acquired or acquired, or conducting the affairs of a limited partnership or limited joint-stock partnership by a general partner, or acting as a proxy) of the Act of 12 December 2013 on foreigners – under the conditions specified in this permit, unless the provisions of law allow for their change;
  17. stay on the territory of Poland in connection with the use of short-term mobility of a managerial employee, specialist or internship employee as part of an intra-corporate transfer under the conditions specified in the art. 139n sec. 1  (notification of the intention of the foreigner to use short-term mobility) of the Act of 12 December 2013 on foreigners;
  18. stay on the territory of Poland in connection with the use of short-term mobility of the researcher under the conditions specified in the art. 156b sec. 1  (conditions for the admissibility of short-term mobility of a researcher on the territory of the Republic of Poland) of the Act of 12 December 2013 on foreigners;
  19. stay on Poland’s territory in connection with student mobility under the conditions specified in art. 149b sec. 1  (conditions for the admissibility of student mobility on the territory of the Republic of Poland) of 12 December 2013 on foreigners;
  20. have a work permit and reside on the territory of Poland:
    • based on a visa, except for a visa issued for the purpose referred to in Article 60, section 1 point 1 or 22 of the Act of 12 December 2013 on foreigners, or
      • based on visa-less travel.
    • Under Article 108 section 1 item 2, or 206 section 1 point 2 of the Act of 12 December 2013 on foreigners or based on a stamp placed in the travel document, which confirms the submission of an application for a residence permit for a long-term resident of the European Union, if immediately before submitting the application they were entitled to work on the territory of the Republic of Poland, or
    • based on a temporary residence permit, except for a permit granted in connection with the circumstance referred to in art. 181 paragraph 1 of the Act of 12 December 2013 on foreigners
    • based on the document referred to in art. 61 of the Act of 12 December 2013 on foreigners, specifying the status of a family member of a diplomatic mission or consular post of a foreign state or another person equal to them based on laws, agreements or commonly established international customs, remaining with this person in the domestic community, if an international agreement or Agreement on the performance of gainful activities by family members of diplomatic missions or consular posts has been concluded between the Republic of Poland and a foreign state or international organization, or
    • based on a visa issued by another Schengen State, or
    • based on a residence permit issued by another Schengen State or

21. are staying on the territory of Poland under art. 108 section 1  of the Act of 12 December, 2013 on foreigners immediately before applying for another temporary residence permit referred to in art. 139a section 1 or Article 25n. 139o sec. 1  of the Act of 12 December 2013 on foreigners, they stayed in this territory based on this permit and continued to perform the work to which they were entitled based on it,

22. perform work as a managerial employee, specialist or intern as part of an intra-corporate transfer referred to in art. 3 point 13b of the Act of 12 December 2013 on foreigners, for the benefit of the receiving entity that applied for a temporary residence permit referred to in art. 139o sec. 1  of this Act, under the conditions specified in this application,

23. carry out scientific research or development works in a scientific unit established in the territory of Poland approved by the minister competent for internal affairs based on the provisions of art. 151 clause 4-5  of the Act of 12 December 2013 on foreigners and applied for a temporary residence permit referred to in art. 151b sec. 1  of this Act, under the conditions specified in the Agreement, referred to in art. 151b sec. 1 item 2 of the Act
