Protection of trade union activists


The employer can only fire a  management board member with the consent of the trade union. He can’t unilaterally change the working conditions or wages to the detriment of such an employee (art. 32 of the Act on Trade Unions). The protection period depends on the resolution of the Management Board. Additionally, it lasts for a maximum of one year after the expiry of the period specified in the resolution mentioned above. Trade union activists can be exempt from the obligation to work while being on the management board. Additionally, suppose they must perform an ad hoc activity resulting from a trade union function. In that case, they can retain the right to remuneration while not working for the company.
