When is unequal treatment allowed?

Different treatment is allowed in some cases. First, the employer may apply measures that improve the employee’s situation based on parental protection or disability.

It is also permissible to apply seniority in determining the conditions of employment and dismissal of employees, the rules of remuneration and promotion, and access to professional training. Seniority may justify better working conditions for an employee loyal to the employer.

It’s also allowed to compensate the opportunities, based on specific characteristics, for example, for disabled workers.

Churches, religious associations, and other religious organisations are allowed not to hire somebody based on their religious beliefs – provided that religion or belief is a decisive occupational requirement for the employee in a given position.
